Fun Bankruptcy Case

MEMORANDUM AND ORDER

MERRITT S. DEITZ, Jr., Bankruptcy Judge.

Is a bus a bus, or is it a car?
Reluctantly we conclude that it is a car.
Bankruptcy petitioner, Theodore Roosevelt Johnson, Sr., has claimed as exempt his 1969 Dodge bus. The bus has a seating capacity of 60 passengers. Upon it are occasionally transported members of Johnson’s church congregation.
The trustee vehemently objects. He points to the state exemption statute, KRS 427.010, which in pertinent part permits the exemption of “one motor vehicle and its necessary accessories, including one spare tire, not exceeding $2,500 in value…”
The trustee patiently explains that the legislature intended the term “motor vehicle” to be synonymous with “automobile”.
Enacted in 1980, the statute excluded earlier statutory limits upon the uses to which a motor vehicle might be put, so we must cast altogether aside the trustee’s concern with the voluminous seating capacity of the behemoth. The record is silent on the size of the petitioner’s family and their transportation needs.
Is a Moped a motor vehicle? What would the licensing arm of the state Department of Transportation say to the contention that a bus is not a motor vehicle? What would Gertrude Stein have to say about what a motor vehicle is?
Such rhetorical questions having been considered, we are bold to say that a bus is a motor vehicle.
In our dialectic, during this era of motorized evolution, we are inclined to regard the “bus” and the “automobile” as species of  the genus, “motor vehicle”.
This Bankruptcy Court is answerable to an appellate forum of literal bent. That is good, for it gives us guidance and certainty in ascribing to the legislature the ability to express its intent in clear, simple, precise English.
As this trustee will recall, District Judge Thomas Ballantine, in reviewing a decision of this court, recently held that a statutory 15-day limitation upon the recording of chattel mortgages imposed a recording limitation not of indeterminate length, as was contended, but a limitation of 15 days.
Guided by that clarity of perception, we find with conviction that a motor vehicle is a motor vehicle, and not necessarily an automobile. We expressly reserve, until it is properly presented, any consideration of the reverse proposition that an automobile is neither a bus nor a motor vehicle.
Abundantly confident that this opinion will find its way alongside Marbury v. Madison and McCulloch v. Maryland in the  lasting library of legal logic, it is hereby
ORDERED that Theodore Roosevelt Johnson, Sr. is entitled to the claimed exemption, and the trustee shall comport his activities accordingly in administration of the estate.

Walkden, England

Just a quick and short update.  I uploaded photos from Scotland this morning.  I hope you find them interesting.  We will see how many more photos it will let me upload for the month.

We are now staying with the Gore family in Walkden.  We arrived later than anticipated after a day of visiting in Runcorn.  We attended church in the Runcorn Ward at the local community center since their building burned down a while back.  It was good to see so many people and that we received such a hearty welcome.  We did go visit a number of families while there.  A couple of which include the Campbell (and Young), Fleming, McWilliam, Johnson, Byrom and more.  A couple of families were not home so we did not visit with them.  It was sure good to be back in Runcorn, despite the fact that you have to drive around in circles to get anywhere you want to go.  Busways might be spectacular, but at the sacrifice of the drivers!

Saturday we made another trip into Liverpool.  The only thing really to mention is that we got lost and had lunch with Gheorghe and Claire Simion family.  Gheorghe was one of my mission companions.  We spent nearly four hours with him and his good wife.  It was convenient he lives in Liverpool now as he was originally from Romania.  It was a great meeting.

We are off to Hyde and Disley today.

May Letter

Here is the letter from May.  It is actually quite a bit better in tone and a bit easier to digest.  I am putting together a response to it at present.Thanks for the card.  Thanks for sending Ione’s obit.  I sent Sal a card and she responded back.  Her thank you card brought tears to my eyes and a lot of flashbacks and old memories.

How come you lost your job?  You ever try looking out of the states for Amanda’s supplies like in Canada?  Any place is probably cheaper than the states.

I called my atty yesterday and I will be another month here.  It is always the hurry up and wait BS.  You are told something then it does not happen.  But I do know I will go some time.  I tis not a sooner or later deal any more.  It is long past later at over 5 years.

Your date on my Grandpa Jonas (Joseph) birth is off by a couple of decades.  He was close to 60 when he was killed per Colleen.  Check it out.  I got a letter from Sis today.  She got an apt in Burley somewhere.  She did not say too much.  I also wrote Milo a small note asking what was up.  Last letter I got from Sis was postmarked April 9th.  She probably got my letter today.  I mailed the one to Milo last night so it got picked up this morning.

Now about Franz.  I want you to check the 2 websites and see if my story is still there of if it is gone.  I told Franz to pull everything.  I want to know if it is still there, if so I will write to find out why.  I am a little surprised at your Paul that you would ever think I would ask for money from people I never know existed.  I asked you once.  I ask Sis cause she had control over mine.  I do not mooch off of anyone one.  If I do not have the currency I go without.  You really do not know me at all do you?  Sad.

Why for do you want to know about my accidents?  You want to know how my innocence was STOLEN too?

By the way my 10 yr old writing mentality comes from not using contracted words.  Try not writing contractions some time then tell me your mentality is 9 yrs old, 1 yr under mind cause you could not figure it out.  Bonehead.

I am curious why you want to know all this stuff now?

Hope you get this in Glen Allen.  I am pushing the time but it should get there by the 6th unless it gets held up here.

Thanks for the Jonas info.  I got looking at the dates of birth and seen Spence and Irwin is like you and Sis a day apart and Ellis and Evan got a day in between plus the 2 years.

One other thing I always thought Dad got married on the 26th!

If and when you ever communicate with Doug again see if he got my letter and if he did ask why he never answered it.

Is there any way you can get autopsy reports?  If so I would like 3: 1 Dad, 1 Colleen, 1 her.  I want to know the exact cause officially of the 3 deaths.
